The rules, in plain words.
These terms are the agreement between you and ChartSkin when you use the ChartSkin browser extension, chartskin.com, or any paid plan. By installing, using or buying ChartSkin you agree to them. If you don't agree, don't use ChartSkin.
Who we are
ChartSkin is run by an independent developer (sole proprietor) based in Ontario, Canada. "ChartSkin", "we" and "us" mean that business. "You" means the person using ChartSkin.
Who can use ChartSkin
You must be at least 13 years old to use ChartSkin. To buy a paid plan you must be the age of majority where you live, or have a parent or guardian agree to these terms and make the purchase for you.
What ChartSkin is
ChartSkin is a visual customization tool. It shows a picture behind the price chart on tradingview.com. It does not place trades, give signals, read your account or change any price data.
We give you a personal, non-exclusive, non-transferable and revocable licence to use ChartSkin for yourself, under these terms and the limits of your plan. You don't own the software; you have permission to use it.
Not financial advice
Nothing ChartSkin makes, including the extension, this website and our TikTok and Instagram posts, is financial, investment, trading or tax advice. Charts, trades and profits shown in our content are there to show what the product looks like and are not recommendations. Trading is risky and you can lose more than you put in. Every trading decision you make is yours alone, and ChartSkin is not responsible for any trading loss. See the full Disclaimer.
TradingView and other services
ChartSkin is independent and is not affiliated with, endorsed by or sponsored by TradingView, Inc. or Google. You use TradingView under TradingView's own terms, and you are responsible for following them.
TradingView can change its website at any time, and that can stop ChartSkin from working, fully or in part, until we update it. We don't promise that ChartSkin will work with every version of TradingView, every browser or every device. A temporary break caused by a third-party change is not a reason for a refund beyond what the Refund policy says.
Paid plans, billing and renewals
Pro is a subscription billed monthly or yearly. It renews automatically at the end of each period, at the then-current price, until you cancel. You can cancel anytime; you keep Pro until the end of the period you already paid for, and you won't be charged again.
Payments are processed by our payment provider (Stripe). We never see or store your full card number. Prices are in US dollars, and sales tax is added where the law requires it.
We may change prices for future periods. If the price of your subscription goes up, we will tell you before it applies, and you can cancel before the new price starts.
Lifetime plan
"Lifetime" means the lifetime of the ChartSkin product, not your lifetime. It gives you Pro features in the ChartSkin Chrome extension for as long as we offer ChartSkin, with no recurring charge. It is for one person and can't be shared, resold or transferred. It doesn't include separate future products (for example a desktop app) unless we say so when you buy.
Refunds
Refunds follow our Refund policy, which is part of these terms. If you open a chargeback or payment dispute without contacting us first, we may suspend your paid features while it is reviewed.
Your photos
You are responsible for the photos you add to ChartSkin. Only use pictures you have the right to use. Your photos stay in your own browser; we don't upload, view or store them, and you keep all rights to them.
What you can't do
Don't copy, resell, redistribute, sublicense or rent ChartSkin or its themes; get around plan limits or licence checks; reverse-engineer it to build a competing product; use it to break the law or anyone's rights; or use ChartSkin's name, logo or artwork to suggest you are us or that we endorse you.
Our content
The ChartSkin name, logo, website, themes, artwork, videos and code belong to ChartSkin and are protected by copyright and trademark law. These terms don't give you any rights to them except the licence to use the extension.
No warranty
ChartSkin is provided "as is" and "as available". To the fullest extent the law allows, we make no promises of any kind, express or implied, including that it will be uninterrupted, error-free, compatible with your setup, or fit for a particular purpose. You are responsible for setting the photo strength so your chart stays readable.
Limit of liability
To the fullest extent the law allows, ChartSkin is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading losses, missed trades, lost data or lost opportunities, however caused, even if we were told they were possible.
Our total liability for any claim about ChartSkin is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $20.
Indemnity
If someone makes a claim against ChartSkin because of how you used it, the photos you added, or your breaking these terms or the law, you agree to cover the reasonable costs, damages and legal fees that result.
Ending access
You can stop using ChartSkin anytime by uninstalling it. We may suspend or end your access, including paid features, if you break these terms, misuse a licence or commit payment fraud. We may also change or discontinue ChartSkin or any feature; if we discontinue a paid subscription, we refund the unused part of your current period.
Your rights under the law
Some places, including Ontario, give consumers rights that a contract can't take away. Nothing in these terms limits those rights. If any part of these terms can't be enforced, the rest still applies.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and ChartSkin agree to the courts of Ontario for any dispute, unless the consumer law where you live says otherwise. Before going to court, contact us so we can try to fix it.
Changes to these terms
We may update these terms. The date at the bottom shows the latest version. If a change is significant we'll point it out on this website or by email. Using ChartSkin after a change means you accept the new terms.
